TD Easy RewardsSM Program Rules and Regulations
Issuer: Your Easy Rewards credit card account is issued by TD Bank, N.A. (hereinafter “we”, “our”, or “us”). In these Programs Rules, “you”, “your”, means the Easy Rewards cardmember obligated on the Account enrolled in the Program noted above.
The TD Easy Rewards program is administered and managed by Helix Global Solutions Inc., a leader in marketing and innovative customer-driven strategies. Helix Global Solutions Inc. is not affiliated with TD Bank, N.A. or Visa U.S.A. Inc., and is solely responsible for administering and managing the TD Easy Rewards program. If you apply for and receive a TD Easy RewardsSM VISA Platinum card, you agree that TD Bank and Helix Global Solutions Inc. may share information about your account transactions with each other for the purpose of administering and managing the TD Easy Rewards program. Travel Agent Services are offered by Odenza Marketing Group Inc (DBA Odenza Vacations). We partner with Orbitz Worldwide, LLC (the “Vacation Package Service Provider”) to provide vacation package search and booking services. Payments for vacation package reservations made through this website will be charged by Orbitz Worldwide, LLC, located at 500 W. Madison, Chicago, IL 60661. Helix Global Solutions Inc., Odenza Vacations or Orbitz Worldwide, LLC are in no way related to TD Bank or any of its affiliates.
Membership: The program will be renewed automatically each year, as long as your Account is open and not in default as defined in your Agreement, unless you notify us of cancellation. The Program is not subject to a yearly program fee separate or above any annual fee that might be part of your Account.
Ability to Earn Rewards/ Earning Restrictions:
Your ability to earn Easy Rewards points and redeem earnings will be based on the status of your TD Easy Rewards Credit Card Account (“Account”). If your Account is closed for any reason, your membership in the Program will be terminated and the total balance of your accumulated points will be forfeited. You will also forfeit any unredeemed points if you cancel your Program membership or the Program is terminated. We may terminate the Program at any time with or without advance notice to you. Additionally, any fraud or abuse related to the accrual or redemption of points will result in forfeiture of accrued points as well as cancellation of membership in the Program as described in your Cardmember Agreement. If your points are forfeited for any reason, we will not reinstate the points to your Account. Points earned are not transferable, cannot be assigned, cannot be used as payment of any obligation to us, and have no cash value except when redeemed in connection with the Easy Rewards Program. There is no restriction or maximum to the number of points that may be earned annually. (“Annually” means the year beginning with your Enrollment Date through the first statement after the anniversary of your Enrollment Date, and each twelve months thereafter.) We reserve the right to approve, deny or revoke participation in the Program to any individual for any reason whatsoever.
Earning Rewards: You will earn 1 point for each $1 of Net Purchases. (“Net Purchases” means purchases of goods and services made by you or any authorized user on your Account minus any returns or refunds.) Point accrual will begin upon the Enrollment Date in the Program. (“Enrollment Date” is the date on which we approve you as a Program member.) No retroactive points will be awarded. You do not earn points on balance transfers, cash advances, any checks that are used to access your Account, money orders, overdraft advances, interest, finance charges, unauthorized or fraudulent charges, or fees of any kind, including fees for products that protect or insure the balances of your Account. Points will be deducted for any returns or credits made on your Account. Points will appear on your monthly statement. From time to time there may be promotional offers for the Program, which provide the opportunity to earn additional points as defined by terms of the promotion.
Expiration: Points will not expire for as long as your account is open and in good standing.
Redemption Process: Points may be redeemed upon request at certain specified levels, which vary by redemption options. To view a complete list of participating partners go to www.tdbank.com/rewards.
Points will be awarded and will be redeemed for rewards on a first-earned, first-redeemed basis. Points earned during the month are available for redemption once they have posted on your monthly billing statement. Once you accumulate the required number of points, you will be eligible to redeem them for your selected reward item. To redeem your points, call toll-free 1-877-745-5040 or redeem online at www.tdbank.com/rewards. Points earned on your Account may only be redeemed by you.
Cash Back: Cash back may only be redeemed upon the request of the primary Account holder and in the form of a paper check, statement credit or electronically deposited into a bank account that was opened by the primary account holder. In order to redeem your points for cash back, points must correspond to $25 or more.
Paper check redemptions can only be sent directly to the cardmember’s statement mailing address as registered on your TD Bank Visa Credit Card Account. Your check should be delivered within 7 - 10 business days from when the request was made. Should you not receive it within that time please contact our Customer Service at 1-877-745-5040. Statement credits should appear within two billing cycles of the request. Statement credits may not be used in place of payment of any portion of a requirement minimum monthly payment or any other required payment, including fees, on any account owed to TD Bank.
Electronic direct deposit can only be credited to a depository account owned by the primary cardmember as registered on your TD Bank Visa Credit Card Account. If the funds are not deposited into your account within seven to ten ( 7-10) business days please contact us at 1-877-745-5040. All cash back redemptions are final.
Points + Cash Redemption Process: All TD Easy Rewards points redeemed under the Points + Cash option must have the cash portion paid in full at time of order, to ensure completion of order. Cash portion may be paid using your TD VISA card; account must be in good standing for completion of transacted order. TD Easy Rewards points will be earned on the cash portion of the TD Easy Rewards redemption.
Enrollment Bonus Points: TD Easy Rewards cardmembers will earn 1,000 bonus points when setting up a User Name and Password on the www.tdbank.com/rewards website. Your TD Easy Rewards credit card account must be open and in good standing at the time the points are posted in order to receive the bonus. This offer is non-transferable and does not apply to cardmembers who already have a User Name and Password. This offer expires 12/31/2017. Upon the creation of an online rewards account, you will be required to provide your email address as part of a mandatory field to populate; said email address is gathered strictly for servicing purposes only. No promotional emails will be sent to you without your express consent first.
Return Policy: All merchandise rewards come with a 30-day return policy from date of order receipt. Please note: All items requiring a return will only be accepted for return consideration within said timeframe and must be in their original packaging with all warranty papers and accessories returned, in order to receive a full credit. Helix and TD Bank reserves the right to review and deny a credit request if item returned is deemed to be in an un-stockable condition. All credits will only be returned once items have been returned and inspected by Helix’s warehouse. Points initially used to purchase the returned item will receive a point credit and a credit back to the applicable credit card if a points + Cash within a seven (7) business days of the Helix warehouse receiving and inspecting the returned item. However, you will see the credit(s) on your statement within 2 billing cycles. Please note that return shipping labels expire within 30 days of the date you make your return request. Any shipping label used after the 30-day period will be null and void, and no further return will be accepted for credit.
Gift Card & Merchandise Restrictions: Redeemed gift card rewards are not refundable, replaceable, or transferable for cash or credit. Lost, stolen or mutilated gift cards will not be replaced. Redeemed rewards earned in the Program may not be re-sold or exchanged for other goods or services except as stated on the reward. All rewards are subject to availability. We may substitute rewards of equal or greater value as necessary at our sole discretion. Gift cards are valid at participating merchants only, through the expiration date, if any, as permitted by law. Merchants participating in the Program are subject to change. Gift cards must be surrendered upon redemption and no photocopies will be honored. Gift cards have no cash value and may not be redeemed for cash or its equivalent, and any unused portion will not be returned as cash unless otherwise noted on the gift card. Gift cards are not transferable, returnable or refundable. Use of any gift card is subject to any additional restrictions listed on the gift card. Please note that laptops/computers/e-readers and iPods are not returnable/refundable and are directly subject to their respective manufacturers’ warranty limitations.
Merchandise Delivery: Delivery of merchandise orders typically take five to ten business days from submission of your order; remember to order early for holidays and special occasions. If your merchandise is being shipped directly from a manufacturer, allow two to six weeks for delivery. Multiple orders may not always be shipped together. You may receive several shipments to complete your order. Deliveries cannot be made to a Post Office Box, rural routes, or to addresses outside of the United States. To check the status of a shipment, call TD Easy Rewards at 1-877-745-5040. Large products are shipped via common carrier truck lines that provide curbside delivery only. Installation of major appliances is not included.
Right to Change/Modify/Cancel: The Program and benefits are offered at our sole discretion. We reserve the right to alter or waive any Program feature or benefit prospectively or retrospectively, including, without limitation, participation fees, points accrual or redemption criteria, or to cancel or temporarily suspend the Program at any time without prior notice.
Program Responsibility: Individual merchants and service providers are responsible for the quality and performance of any goods and /or services redeemed as a benefit of this Program. Any rule of the merchants relating to returns and exchanges of rewards apply. We are not affiliated and are not responsible for redeemed goods and /or services offered through the Program. Any disputes concerning rewards will not affect your payment obligation to us on your Account. We are not responsible for disputes among you or any authorized user relating to the Program. Questions regarding the Program should be directed to the toll-free number on the back of your credit card.
All travelers must meet the minimum age requirement of the travel services they are booking. This age requirement will vary by travel type and supplier. Examples may include but are not limited to: Many car rentals require the renter to be 25 years of age or older. Some will allow the renter to pay a supplement if under 25 and others may not rent at all if under 25; Cruise lines have a variety of age requirements but in general a guest must be 21 years of age if cruising without a parent or guardian that is 25 or older. Various other clauses apply and can be discussed with your travel agent prior to booking; In Las Vegas a guest must be 21 years or older to enter a casino and in some cases to check into a hotel; Other examples will apply on a case by case basis. Your travel agent can answer specific questions. All guests must abide by the travel providers rules and regulations regarding pregnancy. It is the guest’s responsibility to advise their travel agent regarding the fact that they are pregnant prior to finalizing any travel arrangements.
AVAILABILITY AND SUPPLIERS
This program does not have any specific blackout periods associated with it, however all travel arrangements are subject to availability at the time of booking. All travel suppliers and providers are at the discretion of Odenza Vacations. Odenza Vacations will book all travel components through a variety of major North American travel wholesale companies when possible. Most major airlines, car rental companies, hotels and hotel chains, and cruise lines will be eligible within this program subject to availability. Online travel bookings will be authorized through a direct to consumer self-booking system administered by Orbitz Worldwide, LLC.
UNFORSEEN DELAYS & CIRCUMSTANCES
A variety of delays and situations can arise when traveling. Neither Odenza Vacations, Orbitz Worldwide, LLC nor TD Bank are responsible for such circumstances including but not limited to: weather delays; luggage delays; tour cancellations; acts of God; supplier cancellations; acts of war or terrorism; and any other such unforeseen events.
PRICING AND CONTENT
All prices (points) listed in this website are based in USD unless otherwise stated. Airport fees for airports that require payment on site, where applicable, may be excluded in the points but will be highlighted to the traveler prior to final booking when possible. All prices are subject to change without prior notice. Odenza Vacations, Orbitz Worldwide, LLC or TD Bank are not liable for any fluctuation in price or change in schedule or equipment or accommodations in connection with any travel service that occurs before, during or after the purchase of the travel service. All travel services are subject to availability and are deliverable to US addresses only.
Payment is required at the time of purchase for bookings. Purchases can be made using your points or your TD Bank Visa Only. All fraudulent purchases will be investigated and prosecuted.
HOTELS & RESORTS
All hotel reservations will require that you provide a major credit card at the time of check-in. Some hotels/resorts now require you to pay local resort fees. In most cases these fees are not prepaid and must be paid at the resort. Ask your travel agent for details.
All car rental reservations require that you provide a major credit card at the time you pick up their car. A deposit will be placed on car rentals. All prepaid car rentals will require the payment of local taxes and fees at the rental location. Ask your travel agent for details at the time of booking. Please note that car rentals do not include any type of insurance. Some credit cards may cover limited amounts of CDW (collision damage waiver) which is only damage to the rental vehicle you are driving. TD Visa Credit Cards do include the Auto Rental Collision Damage waiver; for details see your Visa Guide to Benefits. This does not include any other type of liability insurance to cover damage to another vehicle or injury to anyone. Please ask your travel agent about insurance inclusive rental options.
Odenza Vacations and Orbitz Worldwide, LLC recommend that you arrive at the cruise departure city the day prior to the commencement of a cruise and not attempt to depart from the cruise departure city until at least 4pm the day the cruise arrives back into port. Many cruise lines now add gratuities to your room account automatically. Please verify with your travel agent the policies of your cruise line regarding gratuities. Optional tours are not included with a cruise. In most cases you can pre-book shore excursions and spa treatments to avoid disappointment when you board the cruise. Ask your travel agent for details. Many cruise lines have now introduced optional dinner clubs in addition to the normal dining rooms. These dinner clubs will require an additional charge. Most cruise vacations do not include beverages in the standard cruise fare. Some cruise lines may include soft drinks but this is not standard across all cruise lines.
CONFIRMATION AND DELIVERY
After a purchase is made, you will receive an e-mail confirming the purchase. It is your responsibility to verify that the information contained in that e-mail correctly reflects the travel services purchased. If the information in the e-mail is incorrect, you must contact the Agency of Choice on the same day on which the on-line booking is made in order to have it corrected. This is for corrections only. Voluntary change requests are subject to penalties and fees once a reservation has been confirmed. Electronic tickets will be delivered by means of e-mail or facsimile transmission. For other travel documents issued by travel service providers, delivery or pick-up arrangements will be made with the customer by the Agency of Choice. If you elect to have any documents delivered by courier, applicable courier charges will be payable by you. Travel documents issued by tour operators for packages purchased within two (2) weeks of the date of travel may be available by airport pick-up only. You are responsible for compliance with the applicable tour operator's airport pick-up conditions.
It is your responsibility to ensure that you and all other persons traveling with you have the appropriate documentation in their possession (such as current and valid passports, visas and identification cards) before leaving the US, and that they satisfy all other applicable requirements (such as vaccinations), to gain entry to the chosen destination and re-entry to the United States. You acknowledge having had the opportunity to review the applicable documentation and other requirements prior to completing the purchase of travel services. Obtaining passports and visas may require lengthy processing times and it is your responsibility to ensure timely receipt of all documents. You acknowledge that entry to another country may be refused even if the required information and travel documents are complete. Specialized notarized documentation may be required for unaccompanied minors and for children traveling without both parents. Ask your Agency of Choice for details.
it is your obligation to check-in at the airport for air travel within the time specified by the applicable travel service provider and, following check-in, to proceed to the correct departure gate by the time specified on the customer's boarding pass. You will be denied boarding if you have not checked in or arrived at the correct departure gate on time. Odenza Travel, Orbitz Worldwide, LLC and TD Bank are not responsible if the you or anyone traveling with you misses his or her flight.
FLIGHT TIMES AND RECONFIRMATION
All flight times, carriers, equipment and itineraries are subject to change with or without prior notice. For air travel, please contact the applicable airline 24 hours prior to departure to reconfirm flight times and status. In the event of an airline schedule change or a flight delay related to weather, traffic or other force majeure situations, it may not be possible for the air carrier to provide meals and/or accommodations. Odenza Vacations, Orbitz Worldwide, LLC and TD Bank are not responsible for lost wages, missed holiday time or any other additional charges and losses incurred as a result of changes in times or itineraries.
CONNECTING FLIGHT TIMES
You should allow for the minimum connecting time approved by the applicable travel service provider in order to reduce the risk of missing connecting flights. All connecting flight reservations are made at the risk of the customer and Odenza Travel, Orbitz Worldwide, LLC and TD Bank are not liable for damages or additional fees incurred by the customer owing to a missed flight connection, whatever the reason.
Air travel to other countries is governed by various conventions and agreements between the United States and other governments, which are incorporated into the terms and conditions of your purchase of applicable air travel services. Incorporated terms may include, but are not restricted to:
a. limits on liability for personal injury or death;
b. limits on liability for lost or damaged baggage and its contents, including fragile or perishable goods, and availability of excess valuation coverage;
c. claims restrictions, including time periods within which passengers must file a claim or bring an action against the air carrier;
d. rights of the air carrier to change the contract;
e. rules on re-confirmation of reservations, check-in times and refusal to carry; and
f. rights of the air carrier and limits on liability for delay or failure to perform service, including schedule changes, substitution of alternate air carriers or aircraft and rerouting. It also is the customer's responsibility to become familiar with the relevant laws and customs of the countries of destination. The customer acknowledges that the living standards and practices at the destination and the standards and conditions there with respect to the provision of utilities, services and accommodation may differ from those found in the United States.
You must consult the terms and conditions of the applicable airline for restrictions on the number and weight of baggage on chartered and scheduled service. Lost or damaged baggage is the responsibility of the airline, which may have limited liability. Odenza Vacations and Orbitz Worldwide, LLC recommend the purchase of insurance for loss of, or damage to, baggage. In the event of damaged, lost or delayed baggage, please contact the applicable airline representative prior to leaving the airport. Failure to do so will invalidate your claim. Many airlines now charge for baggage and any such costs are at the expense of the traveler(s). In the event that Odenza or Orbitz Worldwide, LLC are billed by any supplier or airline following guest travel for charges relating to the guest it will be the responsibility of the guest to reimburse Odenza Vacations or Orbitz Worldwide, LLC for such charges.
Odenza Vacations and Orbitz Worldwide, LLC offer you the option of purchasing travel insurance, including trip cancellation insurance. To insure you against the risks described in the applicable policy that may occur prior to, during or after your trip it is recommended that you purchase travel insurance for all trips or vacations. There are different types of insurance packages available. Travel insurance must be purchased by you at the time of trip purchase to which the insurance relates or prior to the day of departure. You acknowledge that you have been made aware of the availability of travel insurance coverage, including trip cancellation insurance and out of state health insurance, and you have either purchased or expressly declined to purchase that insurance prior to completing the purchase of travel services.
CANCELLATION AND CHANGES
Cancellation penalties for purchased travel services vary depending on the travel service provider. In many cases, the price of travel services is 100% non-refundable from the point that travel has been booked or cancellation carries stiff penalties. Travel service arrangements also may not be changeable or they may be changeable only upon payment of a fee that is determined by the travel service provider. You should consult the terms and conditions of the applicable travel service provider before completing the purchase of travel services.
JURISDICTION AND CLASS ACTIONS
Any provisions of this Agreement pertaining to Odenza Vacations or Orbitz Worldwide, LLC shall be governed by and construed in accordance with the laws of the province in which the Agency of Choice is located and the laws of Canada applicable in it and shall in all respects be treated as a contract. You expressly waive your right to participate in a class action suit against Odenza Vacations or Orbitz Worldwide, LLC for any cause of action arising out of this Agreement. All other provisions of this Agreement shall be governed and construed in accordance with the laws of Delaware, excluding that State’s choice-of-law principles, and all claims relating to or arising out of this contract, or the breach thereof, whether sounding in contract, tort or otherwise, shall likewise be governed by the laws of Delaware, excluding that State’s choice-of-law principles.
The parties submit all their disputes arising out of or in connection with this Agreement to the exclusive jurisdiction of the Courts of Delaware.
